Terms and conditions of sale

ARTICLE 1 – GENERAL PROVISIONS

Nieller is a registered trademark of Taness SARL, a French limited liability company (société à responsabilité limitée) with a share capital of €65,000, whose registered office is located at 11 Route de Capian, 33550 Langoiran, France, registered with the Bordeaux Trade and Companies Register under number 503 930 422 RCS Bordeaux (hereinafter referred to as the “Company”).

The Company designs and sells jewellery products (the “Products”) through its online store available at www.nieller.com (the “Website”).

These Terms and Conditions of Sale govern all purchases made through the Website by private individuals acting as consumers for personal use only (the “Customer”).

By placing an order on the Website, the Customer acknowledges having read and accepted these Terms and Conditions without reservation.

The Company reserves the right to amend these Terms and Conditions at any time. The applicable Terms and Conditions shall be those in force on the date the order is placed.

ARTICLE 3 – PRODUCTS

The Products offered for sale on the Website are described as accurately as possible. However, the Company cannot guarantee the absence of errors or omissions.

Product photographs are intended to represent the Products as faithfully as possible. However, slight variations may occur and photographs are provided for illustrative purposes only.

Products and prices are valid while displayed on the Website and subject to availability.

Should a Product become unavailable after an order has been placed, the Customer will be informed as soon as possible. The Customer may then choose either to maintain the order if an alternative solution is proposed or to cancel the order and receive a full refund.


ARTICLE 4 – ORDERS

To place an order, Customers must be at least eighteen (18) years old and legally capable of entering into contracts.

The Customer undertakes to provide accurate, complete and up-to-date information when placing an order.

The order becomes final once payment has been successfully completed and a confirmation email has been sent by the Company.

Once confirmed, orders cannot be modified or cancelled.

The Company reserves the right to request additional information or documentation in order to verify the identity of the Customer or the validity of the payment method used.

The Company reserves the right to refuse or cancel any order in particular where:

• the order appears fraudulent or abnormal;

• the Customer has previously failed to fulfil payment obligations;

• the order does not comply with these Terms and Conditions.

Electronic communications and computer records maintained by the Company shall constitute valid evidence of transactions between the parties.


ARTICLE 5 – PRICES

All prices displayed on the Website are expressed in Euros (€) and include all applicable taxes.

The Company reserves the right to modify its prices at any time. Products will be invoiced based on the prices in effect at the time the order is confirmed.

In the event of a pricing error, the Company reserves the right to cancel the order or invite the Customer to confirm the order at the corrected price.


ARTICLE 6 – PAYMENT

Payment may be made by credit card, PayPal, bank transfer, or any other payment method made available on the Website.

All online payments are processed through secure payment systems using SSL encryption technology.

By providing payment details and confirming payment, the Customer authorises the Company to charge the relevant payment method for the full amount of the order.

The Company does not store Customers’ payment information.


ARTICLE 7 – DELIVERY

The Company currently delivers to the countries indicated on the Website at the time of purchase.

Delivery costs, where applicable, are indicated during the checkout process prior to order confirmation.

The Customer is responsible for providing accurate delivery information.

Deliveries cannot be made to P.O. boxes.

Upon delivery, the Customer is required to inspect the package and Products. Any visible damage, loss or discrepancy must be reported immediately to the carrier and to the Company.

If a Product is delivered damaged or incomplete, the Company may offer a replacement, repair or refund, subject to verification of the claim.

Delivery times displayed on the Website are estimates only and may vary depending on destination and product availability.

Ownership of the Product transfers to the Customer once full payment has been received and the Product has been delivered.

Risk of loss or damage passes to the Customer upon delivery.


ARTICLE 8 – RIGHT OF WITHDRAWAL

In accordance with applicable consumer protection laws, Customers have the right to withdraw from their purchase within fourteen (14) days from the date of receipt of the Products without providing any reason.

To exercise this right, the Customer must notify the Company within the withdrawal period and follow the return instructions provided.

Returned Products must be:

• unworn;

• unused;

• in their original packaging;

• complete and in perfect condition.

Products showing signs of wear, damage or alteration will not be eligible for a refund.

Refunds will be issued using the original payment method within fourteen (14) days following receipt and inspection of the returned Products.


ARTICLE 9 – LEGAL WARRANTIES

The Products benefit from the legal warranties provided under applicable French law, including:

• the legal warranty of conformity;

• the warranty against hidden defects.

Customers may exercise these rights in accordance with the provisions of the French Consumer Code and the French Civil Code.

Nothing in these Terms and Conditions limits the Customer’s statutory rights.


ARTICLE 10 – INTELLECTUAL PROPERTY

All content available on the Website, including but not limited to trademarks, logos, photographs, illustrations, texts, designs and graphics, is the exclusive property of the Company or its licensors.

Any reproduction, distribution, modification, adaptation or use of such content without the prior written consent of the Company is strictly prohibited.


ARTICLE 11 – GOVERNING LAW AND JURISDICTION

These Terms and Conditions shall be governed by and construed in accordance with French law.

Any dispute arising out of or relating to these Terms and Conditions shall be submitted to the competent French courts, without prejudice to any mandatory consumer protection rights applicable in the Customer’s country of residence.
